Appointment of Enduring Guardian

An Enduring Guardian is the person you legally appoint to make decisions about your health and lifestyle in the event you cannot make these decisions for yourself.

 

Why do I need an Enduring Guardian?

There may be a time in your life, and this can be at any time, when you need someone to make important healthcare, lifestyle and medical decisions for you. This could be due to a temporary or permanent loss of decision-making ability from illness, injury or disability.

If you do not have an Enduring Guardian and decisions need to be made on your behalf, a court or tribunal may need to appoint someone to make decisions for you and this can create unnecessary and stressful circumstances for your loved ones.

What can my Enduring Guardian do?

An Enduring Guardian can assist you with healthcare, lifestyle and medical decisions, which include, but are not limited to:

 

(a)     Deciding where you live;

(b)     Deciding what health care you receive;

(c)      Deciding what other kinds of personal services you receive; and

(d)     Consenting to the carrying out of medical or dental treatment on you.

That said, your Enduring Guardian can only act for you in the event that you cannot make decisions for yourself AND more importantly, it is NOT the guardian's wishes it is your wishes that are important.

 

Who should I appoint as my Enduring Guardian?

It is very important to carefully consider who you appoint as your Enduring Guardian as this is a position of trust when you are at your most vulnerable.

Your Enduring Guardian can be a:

  • Spouse;

  • Family member or members; and/or

  • Close friend who you trust.

 

You can appoint just one person to be your enduring guardian, but we believe that it is preferable to appoint at least two (2) people or a substitute Enduring Guardian.

 

It is important that the person or persons you appoint as your Enduring Guardian understand your needs, wishes, values and beliefs and can make decisions in what are often difficult and emotional circumstances.
